Prof. Louis Aucoin Examines the Impact of Federalism in the US

Since the earliest days of US history when leaders grouped around the “Virginia Plan” or the “New Jersey Plan” through to the modern day, differing views of US federalism persist. This fact no doubt impacts upon external perceptions of the US system, especially when outsiders can see that there are huge discrepancies between the way the states handle major questions of law and society such as gay marriage, the death penalty and a host of other social and legal issues. The purpose of this article is to assess the state of play as it currently exists in the continuing power struggles between the state and national government.
